PlaysJugadas

Four short lessons. Read a Play, then do the Drill that goes with it.Cuatro lecciones cortas.

Play 1Jugada 1 Why the signed agreement comes before any showingPor qué el acuerdo firmado va antes de cualquier visita
Goal: Explain in plain words why a signed written agreement is needed before you show a home, and what it protects.

A buyer representation agreement is a written contract between the buyer and your brokerage. It states what you will do for the buyer, how long the agreement lasts, and how you will be paid.

Since August 2024, NAR rules require a written agreement with the buyer before you tour a home with that buyer. At Canvas, the signed agreement comes before any showing on residential deals, including rentals.

What counts as a showing

Touring a home with the buyer, in person or by live video. If you are not sure whether a situation counts, ask your broker before you go.

Why it matters

  • For the buyer: clear services, clear cost, and clear duties. No surprises.
  • For you: your time and work are protected, and the buyer commits to working with you.
  • For the brokerage: it follows the rules and lowers risk.

What the agreement must show

  • Your compensation as a specific amount or rate, not an open-ended promise.
  • A clear statement that fees and commissions are not set by law and are negotiable.
  • The term: start and end dates.
  • What you will do and what the buyer will do.
  • How either side can cancel.

Say it simply

Before we tour any home, I need us to sign a short agreement. It explains what I will do for you, how long we work together, and how I am paid. It protects you as much as it protects me. I will go through it with you line by line, and you will get a copy.

Common mistake

Showing one home first “to build trust” and planning to sign later. The agreement comes first.

Florida disclosure. Florida also requires a brokerage relationship disclosure before or at the time of a showing. The default relationship is transaction broker unless a different relationship is agreed in writing. Use the forms your broker provides. Confirm directly with your broker or office administrator before acting.

Goal: Explain how you are paid in a clear and honest way, without sounding defensive.
  1. It is negotiable. Fees are not set by law. Never say “this is the standard rate” as if it were fixed.
  2. It is in writing. The agreement states an amount or rate. Your total compensation cannot be more than that amount, from any source.
  3. It can be paid in different ways. Sometimes the seller pays all or part of it, and sometimes the buyer pays. The agreement says who pays what.
  4. Explain the gap. If the seller pays less than the agreed amount, the buyer may owe the difference, depending on the agreement. Say this at the start, not at closing.
  5. Show an example. Use numbers that match the fee your broker allows.

Example only

Agreed fee: 2.5% of a $500,000 price = $12,500.
The seller agrees to pay $10,000.
The agreement says who pays the remaining $2,500.

Say it simply

My fee is not set by law and it is negotiable. It is written in the agreement as [amount or rate]. Often the seller pays part or all of it, but not always. If the seller pays less than my fee, the agreement explains who pays the difference. I would rather explain this now than surprise you at closing.

Common mistake

Telling the buyer “it won’t cost you anything” or “it is free.” You cannot promise that.

Never discuss or agree on your fee with agents from other brokerages. Set your fee only with your broker and your client. Compensation rules are strict and can change. Confirm directly with your broker or office administrator before acting.

Play 3Jugada 3 Exclusive vs. non-exclusive termsTérminos exclusivos vs. no exclusivos
Goal: Explain the type of agreement, the term, the protection period, and cancellation using your broker’s form.

Exclusive

During the term, the buyer works only with your brokerage. Your brokerage is paid under the agreement if the buyer buys a covered property during the term, even if the buyer found it alone.

Non-exclusive

The buyer may work with other agents. Your brokerage is usually paid only if the buyer buys a property that you showed or introduced, as the agreement says. The commitment is lighter for the buyer and riskier for you.

Protection period

A time after the agreement ends when compensation can still apply if the buyer buys a property you showed during the term. Ask your broker what length is allowed.

Explain these four points every time

  1. The term. The start and end dates. A shorter term can help a hesitant buyer, if your broker’s form allows it.
  2. What is covered. The type of property and the area, as written in the form.
  3. The protection period. What it is and how long it lasts.
  4. Cancellation. How the buyer or the brokerage can end the agreement, and what happens next. Be honest and clear.

Brokerage relationship in Florida

The default relationship is transaction broker. The buyer and the brokerage can agree in writing to single agent. A buyer can also choose to have no brokerage relationship. Your broker’s disclosure form explains each one. Read it with the buyer.

Say it simply

Exclusive means that during our agreement you work only with me, and I put my time and my network to work for you. Non-exclusive means you can work with others, but my service is more limited. Either way, we will go through the dates, what is covered, the protection period, and how to cancel before you sign.

Common mistake

Reading the form too fast. If the buyer signs without understanding, the problem comes later. Go line by line and give the buyer a copy.

Exclusivo

No exclusivo

Which agreement types, term lengths, and protection periods are allowed depends on your brokerage and the forms it uses. Confirm directly with your broker or office administrator before acting.

Play 4Jugada 4 Handling “I won’t sign”Cómo responder a “no voy a firmar”
Goal: Find the real concern, answer it honestly, and keep the relationship, without showing homes before the agreement is signed.
  1. Stay calm and ask. “What worries you about signing?”
  2. Listen for the real reason. Often it is cost, fear of a commitment, a bad past experience, an agreement with another agent, or not understanding the form.
  3. Answer that reason. For commitment: explain the term and how to cancel, within what your broker’s form allows. For cost: explain compensation (Play 2). For understanding: go through the form line by line. For a bad past experience: explain what you will do and how you will communicate.
  4. Hold the line kindly. “I understand. Until we have a signed agreement, I cannot tour homes with you. I can explain the process and answer your questions, and we can sign when you are ready.”
  5. Set a follow-up date and record it in your CRM.

Example

Buyer: I do not want to sign anything. The seller pays the agent anyway.
You: That is a fair question. What worries you about signing?
Buyer: I worked with an agent before who stopped answering after a month.
You: That would worry me too. The agreement says how long we work together and how you can cancel. I will also tell you how and when I will contact you. Can we read it together, line by line?
Buyer: OK, but the shorter version.
You: Let me show you the options my brokerage allows. Can we meet Thursday at 6 p.m. to sign, before we tour any home?

If the buyer already signed with another agent

Respect that agreement. Do not try to take the buyer away. Say: “If that agreement ends, please call me.”

Common mistakes

  • Offering to “just show one house.”
  • Criticizing another agent.
  • Pressuring the buyer or saying the fee is “standard.”
  1. Mantén la calma y pregunta. “¿Qué le preocupa de firmar?”
  3. Responde a esa razón.

Ejemplo

Comprador: No quiero firmar nada.

Errores comunes

  • Ofrecer “mostrar solo una casa”.
  • Criticar a otro agente.

Drill 1Práctica 1 A buyer who says “I won’t sign”Un comprador que dice “no voy a firmar”
ProspectProspecto Daniel, 41, project manager. Wants to see two homes on Saturday. Thinks he should not sign anything because the seller pays the agent.
Your goalTu meta Daniel agrees to sign the buyer agreement at a set day and time, before any showing.

A strong result

  • You ask what worries him before you explain anything.
  • You find the real reason and answer it directly.
  • You do not offer to show a home before signing.
  • You do not criticize another agent, pressure him, or call the fee “standard.”
  • You set a day and time to sign.

Act as a real buyer in a role play. Do not break character until the session ends.

Profile: Daniel, 41, project manager. He wants to see two homes this Saturday. He says: "I do not want to sign anything. The seller pays the agent anyway."

Hidden facts. Share each one only when the agent asks a good open question about it:
1. A few years ago an agent stopped answering him after a month, and he is afraid of being stuck with an agent who disappears.
2. He is not working with any other agent.
3. He would sign if the agreement is short, clear, and has an easy way to cancel.

How to behave: Answer in short sentences. If the agent says the fee is "standard" or set by law, argues, pressures you, or criticizes another agent, become more resistant. If the agent offers to show a home before signing, accept happily and note it as a major error at the end. If the agent asks what worries you, listens, explains the term and how to cancel, and offers to read the agreement line by line, soften and start to agree.

Win condition: The agent finds the real concern, answers it clearly, does not offer any showing before the agreement is signed, and gets you to agree to a specific day and time to sign. If that happens, repeat the day and time and end the session. If the agent pressures you or offers a showing before signing, end the session and count it as a major error.

The agent speaks first. When the session ends, write DONE. Then give a score from 1 to 10 and three notes: two things the agent did well and one thing to change. Use plain, simple English.

Dice: "No quiero firmar nada.

ProspectProspecto Patricia, 52, business owner. Analytical and direct. Asks sharp questions about the fee and wants straight answers.
Your goalTu meta Patricia says she understands how your compensation works and agrees to review the agreement on a set date.

A strong result

  • You say that fees are negotiable and not set by law.
  • You explain that the agreement states an amount or rate.
  • You explain who pays if the seller pays less, before she asks.
  • You use a simple example with numbers.
  • You do not say “it is free” or “it is standard.”

Act as a real buyer in a role play. Do not break character until the session ends.

Profile: Patricia, 52, owns a small business. She is analytical, direct, and careful with money. She is interested in buying a home but does not understand why she must sign something about the agent's fee.

Questions to ask during the session, one at a time, in your own words:
1. "The seller pays the agent, right? Why am I signing something about your fee?"
2. "What if the seller does not pay?"
3. "Is the fee negotiable?"
4. "Is there any way this ends up costing me money?"

How to behave: Answer in short sentences. If the agent says the fee is "standard," set by law, or "free," or gives a vague answer like "do not worry about it," become more skeptical and note it as an error at the end. If the agent explains clearly that the fee is negotiable, that it is written in the agreement, who pays if the seller pays less, and gives a simple example with numbers, become more comfortable.

Win condition: The agent answers all four questions clearly and honestly, and you say you understand how the compensation works and agree to review the agreement on a specific date. If that happens, repeat the date and end the session. If the agent calls the fee "free" or "standard," end the session and count it as a major error.

The agent speaks first. When the session ends, write DONE. Then give a score from 1 to 10 and three notes: two things the agent did well and one thing to change. Use plain, simple English.
